What do constitutional courts actually do? And how do they do it? These are the leading questions of Pasquino's paper. Using a comparative approach he'll analyze the mechanisms of access to the courts, the selection of cases and the rules for assigning the cases among the judges, the role of law clerks, how collective decision making and deliberation in the courts proceeds and, finally, how the decisions are drafted and written. Pasquino will particularly draw on examples from courts in Germany, Italy and France, as well as the ECJ in Luxemburg and the ECHR in Strasbourg.

Pasquale Pasquino is Global Distinguished Professor of Law and Politics at New York University and Senior Researcher at the Centre National de la Recherche Scientifique (CNRS) in Paris. He is a foremost expert on European constitutional theory and constitutional courts and currently writing a book “The Divided Power” on the role of courts in the Athenian democracy and in contemporary constitutional Systems.
